Privacy Policy

The Crocker Art Museum is concerned about the protection of the privacy of its website visitors, members and donors. We respect your privacy and your choice not to have your personal information shared with other people. Your use of our website indicates your acceptance of this Privacy Policy.

Website Information
The Crocker only collects personal contact information such as names, addresses, email addresses and phone numbers when the user submits it voluntarily. We will never share your email address with other organizations. To make our website more useful to you, our server automatically collects information when you visit our site, such as but not limited to, your IP address, date and time of your visit, pages viewed and clickstreams. No information that may identify you personally will be collected or tracked.

Mailing Address
We require your mailing address when you sign up for our eNews, but we will not use, sell or exchange your mailing or email address. We do make portions of our member and donor mailing list available to other nonprofit organizations as a means to attract new donors. When we do this, we only share name and address (no phone numbers, email addresses or other data is provided). You may opt-out if you’d prefer we do not share your address with other non-profits. To do so, please contact the Membership Office at 916.264.6730.

Terms and Conditions


General
Crocker Art Museum maintains www.crockerart museum.org and www.digitalcrocker.org (the "Sites") to further its goal of providing access to art. By using the Sites and their content, you agree to be bound by and acknowledge your acceptance of the following Terms of Use as well as the Privacy Policy which is incorporated by this reference, which together set out your entire right with respect to the Sites and their content.

Your continued access to and use of the Sites reaffirms your agreement to be bound by and to abide by these Terms of Use, as amended from time to time, and your acknowledgement that these Terms of Use constitute the legal equivalent of a duly executed and legally-binding contract. If you do not agree with these Terms of Use, you may not use the Sites.

Marks
The trademarks, logomarks and service marks displayed on the Sites (collectively, the "Marks") are registered and/or unregistered Marks of Crocker Art Museum or its licensors. Your access to or use of the Sites does not grant you, by implication, estoppel or otherwise, any right or license to use any Mark displayed on the Sites without prior written permission from the Crocker Art Museum. Your use or alteration of a Mark without such permission is strictly prohibited. Any permitted use of Crocker Art Museum’s Marks by you will inure to the benefit of Crocker Art Museum.

Links to Other Sites
For your convenience, the Sites provide certain links to sites operated by third parties. Crocker Art Museum is under no obligation to review the linked sites and is not responsible for their content. Links to third party sites do not imply endorsement, sponsorship or any affiliation with such sites. Your access of any third party site through a link on the Sites is at your own risk.

No Warranty
Crocker Art Museum makes no representations or warranties as to the truth, accuracy or completeness of the content of the Sites and assumes no liability or responsibility for any errors or omissions in the content of the Sites. ALL CONTENT ON THE SITES IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED ACCESS AND/OR NON-INFRINGEMENT. Indemnification
Upon Crocker Art Museum’s request, you agree to defend, indemnify and hold Crocker Art Museum and its affiliates, employees, contractors, officers, trustees and content providers harmless from any dispute which may arise from your breach of the terms of these Terms of Use, including any and all claims and expenses, including attorneys' fees and court costs related to such breach. Crocker Art Museum reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification of Crocker Art Museum in that matter.

Choice of Law
This Agreement will be construed and enforced in accordance with the substantive laws of the State of California, or the United States of America without regard to principles of conflicts of laws. All matters arising from or relating to the use and operation of the Sites will be governed by the laws of the State of California, without regard to its conflict of laws principles. All claims you may have arising from or relating to the operation or use of the Sites will be heard and resolved in the courts of Sacramento, California. You consent to personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceedings in such courts, and covenant not to assert any objection to proceeding in such courts. If you choose to access the Site from locations other than Sacramento, California, you will be responsible for compliance with all local laws of such other locations.

Amendment of Terms
Crocker Art Museum may at its discretion unilaterally amend these Terms of Use at any time by posting the amended terms of use on the Sites. You may always review the most updated version of the Terms of Use by checking this page. By continued use, you agree to be bound and to abide by such amended terms. These Terms of Use may not be otherwise amended or modified by you, except in writing signed by both parties.
